In accordance with Law no. 296/2004 on the Consumer Code and Law no. 449/2003 on the sale of products and associated warranties, we declare that the delivered product corresponds to the manufacturer’s execution documentation and/or declaration of conformity of the product and we are liable for any lack of conformity existing at the time of delivery of the products.

  • The warranty period provided by the seller for a product is 1 year or equal to the warranty period provided by the manufacturer of that product, whichever is longer. The guarantee period of the products shall be deemed to start on the date mentioned in this certificate and in the invoice proving the sale.
  • The seller shall be liable for the lack of conformity of the products if the lack of conformity occurs within 24 months of delivery of the products, the date mentioned in this certificate and in the invoice certifying the sale.
  • The average life of the product is 5 years, during which time spare parts are provided after warranty.
  • The warranty is valid only on national territory except for those products that benefit from international warranty as established by the manufacturer.

 

Conditions for granting the Guarantee and Compliance

  • Service services within the warranty period are provided at the seller’s premises or at partner services (where applicable).
  • The guarantee is granted upon presentation of the product together with this certificate, the invoice certifying the purchase of the good, the original packaging and all related documentation.
  • The consumer must inform the seller of the occurrence of the lack of conformity of the product (defect) within a maximum of 2 months from the date of discovery.
  • Until proven otherwise, any lack of conformity (defect) occurring within 6 months of delivery of the product shall be presumed to have existed at the date of delivery, unless the presumption is incompatible with the nature of the product or the lack of conformity.
  • The seller is obliged to deliver to the consumer products that are in conformity with the sales contract.
  • Products are deemed to be in conformity with the sales-purchase contract if:
    1. correspond to the description given by the seller and have the same qualities as the products that the seller presented to the consumer as a sample or model;
    2. meet any specific purpose requested by the consumer, which is made known to the seller and accepted by the seller at the time of the conclusion of the sales contract;
    3. correspond to the purposes for which products of the same type are normally used;
    4. being of the same type, exhibit quality and performance parameters which are normal and which the consumer can reasonably expect, given the nature of the product and the public statements concerning its specific characteristics made by the seller, the manufacturer or his representative, in particular through advertising or by means of labelling.
  • The Buyer shall be entitled to demand either repair or replacement of the product, or an appropriate reduction in the price or termination of the contract, in accordance with the law and this certificate.
  • Any repair or replacement of the product within the warranty period will be resolved within a reasonable period of time, maximum 30 days.
  • The consumer may claim a price reduction or rescission of the contract if the trader can neither repair nor replace the product, if he cannot remedy the defect within a reasonable period of time or if he has not carried out the repair without significant inconvenience to the consumer.
  • The period of non-functioning due to lack of conformity of the product shall extend the period of conformity accordingly; this shall be stated in this certificate.
  • In case of replacement of an equipment or part, the new part becomes the property of the beneficiary and the defective part becomes the property of the seller.

Husqvarna Warranty Policy
Husqvarna Pădure & G Jardin SRL guarantees the operation of all products sold under the Husqvarna brand and will repair or replace any parts with manufacturing defects, installation defects or defective parts resulting from interventions by Husqvarna authorized workshops during the warranty period.

Guarantee periods
Individuals:
Full product range: 24 months for machinery and accessories.

Legal entities:
Garden product range: 12 months for machinery and accessories.
Forestry and micro agriculture product range: 6 months for machinery and accessories.

 

Warranty and Compliance Limitations and Exclusions

  • The seller may refuse to repair or replace the non-conforming product at the consumer’s option if it is impossible or disproportionate in comparison with alternative solutions which are available taking into account the value of the non-conforming product or the significance of the lack of conformity and if an alternative repair could be achieved without significant inconvenience to the consumer.
  • The consumer is not entitled to request termination of the contract if the lack of conformity is minor.
  • If the seller does not find a defect for which he is liable, the situation is an unjustified warranty claim, for which he may ask the Buyer to pay the cost of the diagnostic work on the product in accordance with the consulting hourly rates.
  • A lack of conformity shall not be deemed to exist if the consumer knew or could not reasonably have been unaware of the lack of conformity at the time of the conclusion of the contract of sale or if the lack of conformity has its origin in the materials supplied by the consumer.
  • Consumables and accessories are not covered by warranty – please check for proper functioning at time of purchase
  • The warranty will not be granted if it is found that the instructions for installation, commissioning, use, maintenance, handling, transport and storage of the product as set out in the accompanying documentation and as presented when the product was delivered have not been followed.
  • Software problems are not covered by the warranty and their resolution requires the customer to pay the applicable service fees.
  • We are not responsible for any incompatibilities between systems or sub-assemblies delivered by us and products of other companies.
  • No warranty is given for defects caused by mechanical shocks or voltage fluctuations/surges, lack of grounding, use or exposure to improper environmental conditions (improper voltage supply, excessive humidity, liquids, dust, improper temperatures, etc.).
  • The guarantee does not cover damage resulting from faulty transport (unless it is carried out by our company), accidents, lightning, flood, fire, etc.
  • The guarantee is lost if the product is tampered with by persons not authorised by the seller.
  • The warranty is lost if the type or serial number on the product has been altered, deleted, replaced or made illegible.
  • Software packages are only guaranteed for the integrity of the programs on the storage medium. Any defects must be reported within 30 days of delivery.
  • Under no circumstances shall the warranty cover any loss of information due to product failure and the supplier shall not be liable for any damage caused by such loss. In this respect, it is recommended that buyers benefit from a system of periodic saving of important programmes or data. Before coming to the authorised service point, please make backup copies of your personal data. Data integrity is not ensured by the warranty conditions: loss of data due to servicing or media defects cannot be attributed to the vendor.
